These End User License Agreement and Terms of Use (“Terms”) govern your access to and use of the BANISH mobile application (“BANISH,” the “App,” “we,” “us,” or “our”), operated by Lauren Melzer, a sole proprietor.

By downloading, accessing, or using BANISH, you agree to these Terms. If you do not agree, do not use the App.

1. What BANISH Is

BANISH is a self-reflection and wellness tool designed to help users recognize unwanted or negative thoughts, express them temporarily within the App, and engage in a digital ritual of letting them go.

BANISH is intended for general wellness, personal reflection, and entertainment purposes.

BANISH is not therapy, counseling, medical care, psychiatric care, crisis intervention, or a substitute for professional mental health treatment.

We do not diagnose, treat, prevent, or cure any medical or mental health condition.

If you are experiencing a medical or mental health emergency or believe you may harm yourself or someone else, contact emergency services or an appropriate crisis service immediately.

2. Your Thoughts Are Not Stored

BANISH is intentionally designed so that thoughts entered into the banishing experience are temporary.

Thoughts you enter for the purpose of completing a BANISH ritual are not stored in our database, are not accessible to us, and are deleted as part of the experience.

BANISH does not send the content of those thoughts to an artificial intelligence provider or other third party for analysis.

Because this content is not stored, we cannot retrieve or recover a thought after it has been banished.

3. Accounts

You may be able to use certain BANISH features without creating an account.

If you choose to create an account, you agree to provide accurate information and are responsible for maintaining the security of your account credentials.

You may not impersonate another person, access another person's account without permission, or use BANISH for unlawful or abusive purposes.

4. License to Use BANISH

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use BANISH for your personal, non-commercial use on Apple-branded products that you own or control, as permitted by Apple's applicable usage rules.

BANISH is licensed to you, not sold to you.

You may not copy, modify, distribute, sell, sublicense, reverse engineer, attempt to extract source code from, or create derivative works from BANISH except where applicable law expressly permits such activity.

5. Acceptable Use

You agree not to use BANISH:

• For unlawful purposes;

• To interfere with or disrupt the operation or security of the App;

• To attempt to gain unauthorized access to BANISH systems or accounts;

• To copy, scrape, reverse engineer, or exploit the App;

• To introduce malicious code or otherwise damage the App or its users; or

• In any manner that violates applicable law.

We may suspend or terminate access to BANISH if we reasonably believe these Terms have been violated.

6. Intellectual Property

BANISH, including its name, branding, designs, graphics, animations, destruction experiences, text, software, interfaces, and other original content, is owned by Lauren Melzer or our applicable licensors and is protected by intellectual property laws.

These Terms do not transfer ownership of BANISH or any associated intellectual property to you.

7. Purchases and Subscriptions

BANISH may offer paid features, subscriptions, lifetime access, or other in-app purchases.

Purchases made through Apple's App Store are processed by Apple and are subject to Apple's applicable payment and subscription terms.

Prices and available offerings may change from time to time, subject to applicable law and App Store requirements.

If BANISH offers an automatically renewing subscription, the applicable price, billing period, and renewal terms will be disclosed before purchase.

Subscription management and cancellation are handled through your Apple account settings.

8. No Guarantee of Results

Everyone's experience with BANISH is different.

We do not guarantee that using BANISH will eliminate negative thoughts, improve self-esteem, change behavior, improve mental health, or produce any particular personal outcome.

BANISH is simply a tool you may choose to incorporate into your own wellness practices.

9. Disclaimer of Warranties

To the fullest extent permitted by applicable law, BANISH is provided on an “as is” and “as available” basis.

We do not guarantee that the App will always be available, uninterrupted, error-free, secure, or compatible with every device.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer protection law.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Lauren Melzer and BANISH will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use BANISH.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

11. Changes to BANISH

BANISH is an evolving product.

We may add, remove, modify, discontinue, or change features of the App from time to time.

We may also update these Terms when necessary. If we make material changes, we will provide notice as required by applicable law.

Continued use of BANISH following the effective date of updated Terms constitutes acceptance of those Terms where permitted by law.

12. Termination

You may stop using BANISH at any time.

We may suspend or terminate access to the App if you materially violate these Terms or if necessary to protect BANISH, its users, or others.

Sections that by their nature should survive termination will continue to apply.

13. Apple-Specific Terms

You acknowledge that these Terms are between you and Lauren Melzer, not Apple Inc. (“Apple”).

Lauren Melzer, and not Apple, is solely responsible for BANISH and its content.

Your license to BANISH is limited to a non-transferable license to use the App on Apple-branded products that you own or control, subject to the usage rules contained in the Apple Media Services Terms and Conditions.

Apple has no obligation to provide maintenance or support services for BANISH.

To the extent any warranty applies and BANISH fails to conform to that warranty, you may notify Apple, and Apple may refund the purchase price, if any, in accordance with its policies. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to BANISH.

Lauren Melzer, not Apple, is responsible for addressing claims relating to BANISH, including product liability claims, claims that BANISH fails to conform to applicable legal requirements, and claims arising under consumer protection or similar legislation.

Lauren Melzer, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to BANISH.

You represent that you are not located in a country or region subject to applicable U.S. government embargoes and are not listed on an applicable U.S. government prohibited or restricted parties list.

You agree to comply with applicable third-party terms when using BANISH.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce the applicable provisions against you as a third-party beneficiary.

These provisions are included to address Apple's minimum EULA requirements.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except where applicable consumer law requires otherwise.

Nothing in these Terms deprives you of mandatory protections provided by the laws of your jurisdiction.
